This section provides additional information for California Residents.
PRIVACY STATEMENT – CALIFORNIA – Commercial Insurance
This Privacy Statement – California – Commercial Insurance supplements the information contained in the MSIGUSA.com Privacy Policy (MSIG is “we,” “us,” or “our”) and applies solely to Customers, Claimants, and consumers who reside in the State of California (“consumers” or “you”). A separate Privacy Statement applies to Seven Hills Insurance Agency LLC.
This Privacy Statement describes our collection, use and disclosure of California Consumer personal information (“PI”) as well as the rights California Consumers have under the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws.
Collection and Use of Personal Information
The table below shows the types of PI we may have collected in the past 12 months (or not collected, if indicated below), the sources from which we may collect this information, why we collect it, and with whom we may share it. The chart is representative.
We will not collect additional categories of PI or use the PI we collected for materially different, unrelated, or incompatible purposes without providing notice.
When we disclose PI to a service provider, we do so for a business purpose and pursuant to a written contract that describes the business purpose(s) for the disclosure, specifies the services to be performed, and prohibits the recipient from further using, retaining, or disclosing the PI other than as specified in the contract. We may also disclose PI pursuant to an exemption from the CCPA.
Your Rights and Choices
The CCPA provides California Consumers with specific rights regarding their PI. You may also appoint a representative to exercise your rights. This section describes your CCPA rights and explains how to exercise those rights.
Access to Categories of Information and Specific Information Rights
You have the right to request that we disclose certain information to you about our collection and use of your PI over the past 12 months. You are limited to two requests in a 12-month period. Once we receive and confirm your verifiable consumer request, we can disclose to you:
- The categories of PI we collected about you.
- The categories of sources for the PI we collected about you.
- Our business or commercial purpose for collecting that personal information.
- The categories of third parties with whom we share that personal information.
- The specific pieces of PI we collected about you.
- If we disclosed your PI for a business purpose, a list identifying the PI categories that each category of recipient obtained.
Deletion Request Right
You (California Consumers) have the right to request that we delete any of your PI that we collected directly from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete your PI from our records, unless an exception applies.
Verifiable Consumer Request
You may exercise your access and deletion rights described above by submitting a verifiable consumer request to us. A verifiable consumer request is a request made by a consumer, by a consumer on behalf of the consumer’s minor child, or by a person registered with the California Secretary of State and that we can reasonably verify that the consumer is the consumer about whom we have collected PI.
To verify the consumer we will need your name, policy number and/or claim number.
Your request should also have sufficient detail that allows us to properly understand, evaluate, and respond to it. In other words, tell us if you are requesting categories of information we collect, specific information we collect, or requesting deletion of your PI.
Verifiable consumer requests should be sent to us at the contact information below.
We will make commercially reasonable efforts to identify your PI and to respond to requests, but if we cannot identify your PI, we will tell you. You may submit additional information for us to search again. If there is irrelevant or voluminous data, we may provide a summary of that data or may request a fee for collecting and sending your PI to you. We may verify a requestor’s identity by matching known information internally or via an outside service.
We cannot respond to your request or provide you with PI if we cannot verify your identity or authority to make the request and confirm the PI relates to you. We will only use PI provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request, unless the information was provided for another purpose.
“Do Not Sell”
We do not sell PI. In the preceding 12 months we have not sold PI as defined under the CCPA, and until such time as our practices change by updating this Privacy Notice, we will treat PI collected under this Privacy Statement as subject to a “do not sell” request.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
